Terms of Service

By commissioning me, you have agreed to have fully read and agreed to my Terms of Service. Breaking any of these rules may lead to being permanently blacklisted from commissioning me. These Terms of Service are subject to change without notice.

General Guidelines:

• I have the right to refuse a commission for any reason, even if it is not in my "will not draw" category.
• I retain the rights to my artwork *, and to post it on social media/include in my portfolio. If you would like to request me to not repost or use your commission in such a way, please let me know in advance. Rest assured I understand wanting it private completely, and will honor your request!

* I will not claim rights to your own IP - your characters are yours. This is simply for the artwork itself.

Process + Delivery:

• Delivery can vary from 1 week-1 month depending on various factors such as complexity, current queue, and my health. If there is further delay, you will be notified ASAP.
• You will receive multiple WIPS for sketches, clean line-art, and colored to give feedback and revisions.
• When the commission is finished, you will receive a watermarked and unwatermarked/personal use version. If uploading your commission to other websites, it is recommended to use the watermarked version to prevent art theft. Please credit me via this Carrd or any socials listed on it when reposting on other websites (my preference besides this carrd is my Toyhou.se)

Payment:

• I take payment/commissions with Paypal via my Artistree. This streamlines my process and makes the fees easier on both parties. You do not need an account as a customer.
• I will only begin working on the commission once payment has been received in full.
• I do not do refunds if a commission has passed the sketch stage.

Art Usage:

The customer has the right to:
• Claim rights to their character, but not the art itself
• Use the artwork for online personal use (such as a profile picture)
• Edit the artwork
• Share/repost the artwork, if properly credited
• Make prints/keychains/etc. for personal use only (for the customer, not sold to anybody)

The customer does NOT have the right to:
• Claim the art as their own
• Trace the artwork
• Use the artwork for NFTS
• Use the artwork in AI/AI training
• Lie about price paid for the artwork
• Use the artwork for commercial services without my consent*

*commercial rights can be purchased for 50% of the base price

*complex characters may be simplified if possible. Complex characters and props may result in a mutually agreed upon fee no more than 25% of the base price, but I actively try to avoid charging this by simplifying!
